Amicus Curiae #Justice4Moldova: Position Paper on complaints no. 282a/2023 and no. 60a/2024

This Opinion has as its object the notifications no. 282A/2023 and no. 60a/2024 regarding the review of the constitutionality of some provisions of the Law no. 65 / 2023 on the external evaluation of judges and candidates for the position of judge of the Supreme Court of Justice and from Law no. 252 / 2023 on the external evaluation of judges and prosecutors and the amendment of some normative acts , notifications to which the unique registration number “282a” was assigned.

The conclusion of the Group of Experts in the Field of Justice (GEJ) is that most of the provisions, whose constitutionality is requested to be verified, have been examined and subjected to an in-depth analysis, including repeatedly, by the Venice Commission, which exposed itself through the opinions and opinions communicated to the authorities at the stage of drafting and adopting Law no. 65/2023 and Law no. 252/2023. The authorities have amended the draft laws, reflecting most of the recommendations put forward by the Venice Commission.
